About the role

As the Principal Investigations (Australia), you will manage and oversee business conduct investigations, as part of the Investigations Framework for BHP internal investigations. Reporting to the Head of Ethics & Investigations, the responsibilities of the role include:

§  Supports the design and implementation of BHP’s global Investigations Framework (including methodologies and tools).

§  Draws on developments in international best practice, regulatory guidance and learnings from investigations to drive continuous enhancement of the Investigations Framework.

§  Prepares Investigation Framework training materials for roll out on a global basis; delivers training to additional designated resources from Internal Audit & Assurance, Ethics & Compliance, Legal and Human Resources and guidance to personnel undertaking business conduct investigations for matters which are not Significant Matters.

§  Directs the investigation of Significant Matters across BHP’s global operations, including by:
§  Devising investigation plans;
§  Leading investigations;
§  Undertaking or supervising forensic review of electronic communications and documents;
§  Conducting interviews with reporters (where relevant) and other key personnel and / or third parties to obtain the facts of the issue, which may include interviews with senior executives;§  Preparing supporting documentation for investigations, including records of witness accounts and investigation reports; and
§  Supporting / mentoring additional designated resources from Internal Audit & Assurance, Ethics & Compliance, Legal and Human Resources who are conducting Significant Matter investigations.
§  Supports / mentors personnel undertaking business conduct investigations for matters which are not Significant Matters.
§  Prepares briefings to the Integrity Working Group (comprising heads of function from Legal, Ethics & Compliance, Group Health Safety & Environment, Internal Audit and Assurance and Human Resources, with a rotating senior business representative) on the progress of Significant Matter investigations and findings. Supports the Integrity Working Group in developing recommendations on the basis of findings.
§  Collates data and reports to the Integrity Working Group on investigations and the efficacy / scope for improvements to the Investigations Framework.
§  Supports engagement with key stakeholders, including reporting to Executive Leadership Team members on investigations trends.
§  Manages external counsel within partnering law firms.

About You

You will have a strong academic background based in Legal or Accounting disciplines, coupled with experience working in government, corporate and/or forensic investigations.  You will have gained experience working in government and/or corporate investigations and/or forensic investigations; exposure to and involvement with complex matters and sensitive internal investigations into conduct which may potentially have serious disciplinary or criminal consequences for employees. You will also possess a solid understanding of forensic technology issues, including legal and regulatory evidence preservation obligations.

Please note this role requires regular travel to support regional investigations.
