About the Role

The Marketing & Maritime Legal team provides legal support to BHP’s global Sales & Marketing (Marketing) and Maritime and Supply Chain Excellence (Maritime) Functions.

 

Within this Legal team, the Legal Counsel – Marketing (Liquids and Carbon) is responsible for acting as the key Legal business partner for the Liquids (diesel, LNG, LPG, maritime fuels and emerging low carbon fuels) and Carbon Desk teams in Marketing and Maritime. 

 

The role reports to the Head of Legal – Marketing & Maritime and can be based in Singapore, Perth or Brisbane. International and/or domestic travel may be required to meet business requirements, subject to prevailing company policies. 

 

This role has a number of responsibiltlies across the Liquids business team and Carbon desk team. Core accountabilities include, but are not limited to: 

  • the drafting, negotiation, execution and performance of contracts for the procurement of liquid energy or similar (e.g. diesel, LNG, LPG, maritime fuels and emerging low carbon fuels such as biodiesel and ammonia) and ancillary services for BHP’s Assets globally and BHP’s Maritime business;
  • the drafting, negotiation, execution and performance of contracts relating to the sale and purchase of carbon offsets and other relevant contracts for regulatory and voluntary carbon markets for BHP’s Assets globally;
  • defaults, disputes and price reviews under liquids procurement and ancillary contracts; 
  • legal due diligence on carbon offset origination projects; 
  • with other members of Marketing & Maritime Legal, legal advice and support in respect of BHP’s commodity sales and maritime contracts where input regarding the supply and use of liquids energy and carbon offsets is required;
  • Identify legal risks, regulatory developments and other legal issues affecting carbon markets and liquid energy (including emerging low carbon fuels), participate in risk and opportunity assessments and advise on risk and opportunity management.
  • Establish and maintain relationships with Liquids and Carbon Desk stakeholders, and act as a primary contact for legal issues. 
  • Identify and implement continuous improvement to systems, standards, tools and processes, including enhancement of BHP’s standard contract suite, precedents and supporting materials in relation to Liquids procurement and Carbon offsets.

About You

You will be capable and possess sound judgement. With strong technical legal skills, commerciality,and a focus on strategic problem solving you will be able to deal well with ambiguity. 

An excellent communicator, you will have exemplary organisational and analytical skills to support your ability in providing concise, clear, practical, commercial advice in a timely manner to relevant stakeholders. 

You will have demonstrated ability to manage multiple complex projects, manage competing deadlines and changes will be crucial to your success in this role 

 

More formal requirements include: 

 

  •  5+ years Post Qualification Experience in a well-regarded law firm or in-house legal team. 
  • Bachelor of Laws (LLB) or Juris Doctor (JD) degree.
  • Entitled to practice law in a major common law jurisdiction (e.g. Australia, Singapore, Canada or England and Wales) or a civil law jurisdiction where BHP has operations (e.g. Chile or Brazil).
  •  Previous energy and/or resources experience, ideally including the global sale and purchase of traded commodities generally or carbon and/or liquid energy specifically. Experience in drafting, negotiating and advising on complex commercial agreements, for example, commodity sales and purchase agreements (including energy and/or carbon), joint venture agreements or project agreements. Understanding of the global legal and regulatory framework and developments applicable to energy and carbon and the trading of commodities would be ideal but is not essential.
