About the Role
Reporting to the Legal Manager, this role provides legal advice to Assets primarily located in Chile, managing environmental, regulatory, contractual and operational matters. This role advises the business in complex environmental matters, in the identification and management of legal risks, and gives strategic advice. The role is based in Santiago, Chile, BHP’s worldwide headquarters for Minerals Americas.
Duties and Responsibilities
• Provide legal and strategic advice to Minerals Americas business on a variety of issues, including, but not limited to mining, environmental, contractual and corporate issues.
• Business as usual support, such as interpretation and application of regulation, contracts’ clauses, clarification of legal implications around commercial and technical decisions, third party claims, among others.
• Assist in connection with the relationship among the owners of the Assets, including JV interpretation, competition ring-fencing, among others.
• Negotiate and draft all kind of contracts as required by the BHP’s Minerals Americas business.
• Define the strategy for, and manage, local litigation.
• Give legal advice in relation to administrative investigations against the company, defend the company in such investigations and manage legal actions and appeals against administrative decisions contrary to the company’s interests.
• Assume a leading role in complex environmental matters.
• Work on legal projects as assigned by the Head of Legal Minerals Americas.
• Manage outside legal counsel engagements to ensure productive and cost-effective representation.
• Actively represent Legal in different forums within the company, attending meetings as appropriate.
• Participate in material risk assessments and verification.
• Work in global Legal projects as assigned by Head of Legal Minerals Americas.
• Foster trusted advisor relationship with the business and key stakeholders.
• Execute the analysis and improvement activities as required by the Head of Legal Minerals Americas.
• Own the implementation of the Legal governance requirements for areas of accountability.
• Advise the Head of Legal and management representatives on all significant matters, assist in the overall provision of legal services to BHP, and perform such other job-related duties and functions as requested by the Head of Legal and management of Minerals Americas.
• Contribute to the adequate management of the legal budget allocated for the functions under the relevant scope.
• Travel within Chile and internationally, as necessary, to progress open matters.
About You
To be a Top Performer you will need:
• Experience:
General Experience: Minimum of five (5) years of experience as attorney in law firms or corporate legal department as in-house.
Specialized Experience: Environmental and regulatory experience is preferred.
• Education: Law Degree or Juris Doctorate.
• License: Valid Chilean practicing certificate.
• Strong interpersonal skills: a team player who works effectively with others at all levels and in all disciplines in a team environment.
• Language skills: Fluent in Spanish and English is a must.
