The Challenge Ahead

 

As Legal Counsel (Specialist) – Potash Marketing, you will play a critical role in supporting BHP’s entry into the global potash market. You will work closely with the Potash Sales & Marketing team to enable the sale and distribution of potash across the Americas, while navigating complex regulatory frameworks and commercial landscapes.

This is an exciting opportunity to help shape a new business during a pivotal moment—supporting the ramp-up of first production in a new commodity for BHP and the development of sales channels and supply chains required to deliver potash to our customers.

You will collaborate with diverse stakeholders across Legal, Marketing, Finance, and External Affairs, contributing to strategic initiatives, continuous improvement, and risk management within a fast-evolving environment.

Key Responsibilities

 

  • Provide legal advice to the Potash Sales & Marketing team on commercial and operational matters.
  • Draft, review, and negotiate agreements, including:
    • Commodity sale and purchase agreements;
    • Logistics and supply chain contracts (rail, trucking, barging, storage); and
    • Memoranda of understanding and other commercial arrangements.
  • Support the development of sales channels and distribution networks across the Americas.
  • Conduct legal and regulatory due diligence for international trade, including export/import and fertilizer regulations.
  • Advise on disputes related to potash sales and logistics.
  • Contribute to internal risk assessments and provide guidance on risk mitigation strategies.
  • Collaborate with broader Legal teams on incidents, production matters, and disputes.
  • Deliver legal training and develop guidance materials for stakeholders.
  • Manage external legal counsel, including budgets and performance.
  • Participate in governance reporting and continuous improvement initiatives.

What You'll Bring to the Role

 

  • Qualified lawyer with admission to practice in the United States (Colorado/Denver).
  • A minimum of five years post-qualification experience in a highly regarded law firm or in-house legal team.
  • Experience advising on international commodity sales, logistics, and trade-related legal matters.
  • Strong capability in drafting and negotiating complex commercial agreements.
  • Understanding of regulatory frameworks impacting global trade and commodities.
  • Ability to translate complex legal concepts into clear, practical advice for business stakeholders.
  • Strong organizational skills, with the ability to manage multiple priorities and deadlines.
  • Confident communicator who can build relationships and influence decisions.
  • Collaborative mindset with strong interpersonal and stakeholder engagement skills.
  • Curiosity, initiative, and a continuous improvement mindset.

Salary Range

 

$172,000 - $215,000

The starting salary will be determined based on relevant experience, education, internal equity, and market considerations.

Work Location

 

This role supports the Americas region and will work closely with global stakeholders.

This role is based in Denver, CO. BHP supports hybrid working arrangements, combining office-based work with flexibility to work from home. The role is full-time, 40 hours per week. Travel within North America and internationally may be required.
